Terms of service

These Terms of Service ("Terms") govern your access to and use of the PokeIndie website, applications, and related services (together, the "Service"). PokeIndie is operated by MML Digital Foundry ("PokeIndie", "we", "us", or "our"), with a registered address at Global. By creating an account, accessing, or using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. Who may use the Service
You must be at least 16 years old (or the minimum age of digital consent in your country, if higher) to use the Service. If you use the Service on behalf of a company or other organization, you represent that you are authorized to bind that entity to these Terms. You are responsible for complying with all laws that apply to your use of the Service.
2. Your account
- You may register with an email address or through a supported provider (Google, Discord, Twitch, or Kick). You are responsible for the accuracy of the information you provide and for keeping it current.
- You are responsible for safeguarding your credentials and for all activity that occurs under your account. Notify us promptly at [email protected] of any unauthorized use.
- We may refuse, suspend, or terminate accounts, and reclaim usernames, at our reasonable discretion, including where required to comply with law or to protect the Service and its users.
3. Acceptable use
You agree not to misuse the Service. Prohibited conduct includes, without limitation: violating any law or third-party right; posting unlawful, infringing, deceptive, or harmful content; harassing or abusing others; uploading malware; scraping or accessing the Service by automated means except as expressly permitted; interfering with or circumventing security, rate limits, or ranking systems; and manipulating engagement metrics ("pokes"), reviews, or rankings. Additional rules are set out in our Acceptable Use Policy and Community Guidelines, which form part of these Terms.
4. Developer listings and user content
The Service lets developers publish game listings and lets users submit content such as profiles, messages, and collections ("User Content"). You retain ownership of your User Content. You grant us a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, adapt, publish, and display your User Content solely to operate, promote, and improve the Service.
- You represent that you own or have the necessary rights to your User Content and that it does not infringe any third-party rights.
- You are solely responsible for your listings, including their accuracy, pricing information, external links, and legal compliance (for example, age ratings and consumer-protection disclosures).
- We may review, moderate, reject, re-review after edits, or remove content that violates these Terms, and may re-queue an edited listing for review before it is shown publicly.
5. Intellectual property
The Service, including its software, design, text, and trademarks, is owned by PokeIndie or its licensors and is protected by intellectual-property laws. Except for the rights expressly granted to you, we reserve all rights. You may not copy, modify, distribute, or create derivative works from the Service without our permission.
6. Copyright and takedowns
We respect intellectual-property rights and respond to valid notices of alleged infringement in accordance with our Copyright and Takedown Policy. Repeat infringers may have their accounts terminated.
7. Premium subscriptions, coins, and payments
- PokeIndie Premium is offered as recurring monthly or yearly plans processed by our payment provider, Stripe. By subscribing you authorize recurring charges until you cancel.
- Subscriptions renew automatically at the then-current price unless cancelled before the renewal date. You can cancel at any time from your billing settings; access continues until the end of the paid period.
- Prices may change; we will give advance notice and changes apply to subsequent billing periods. Taxes may apply based on your location.
- Refunds are handled under our Refund Policy and any mandatory rights you have under local consumer law.
- "Coins" and similar in-Service items have no monetary value, are not property, cannot be exchanged for cash, and may be adjusted or removed as described in the Service.
8. Third-party services and links
The Service integrates with and links to third parties (for example Discord, Twitch, Kick, Stripe, Google, and external game or store pages). We do not control and are not responsible for third-party services or content. Your use of them is governed by their own terms and privacy policies.
9. Suspension and termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the Service or others. Provisions that by their nature should survive termination will survive.
10. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that content is accurate. Nothing in these Terms excludes any warranty or liability that cannot be excluded under applicable law.
11. Limitation of liability
To the maximum extent permitted by law, PokeIndie and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill. Our aggregate liability for any claim relating to the Service will not exceed the greater of the amounts you paid us in the 12 months before the claim or EUR 100. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
12. Indemnification
You agree to indemnify and hold harmless PokeIndie from claims, damages, and expenses (including reasonable legal fees) arising from your User Content, your use of the Service, or your breach of these Terms, except to the extent prohibited by applicable law.
13. Changes to the Service and these Terms
We may modify the Service or these Terms. If we make material changes, we will provide reasonable notice (for example by updating the date above or notifying you). Your continued use after changes take effect constitutes acceptance. If you do not agree, stop using the Service.
14. Governing law and disputes
These Terms are governed by the laws of Global, without regard to conflict-of-law rules, and the courts of that jurisdiction will have exclusive competence, unless mandatory consumer-protection law in your country of residence provides otherwise. Nothing here deprives you of protections you cannot waive under local law.
